This document does not constitute a binding agreement to sell or purchase a property. It merely constitutes a reservation subject to finalisation of pre-contract.

Important: If purchasing in a SMSF and you intend to borrow against the property, the purchaser name should be the Trustee for the Custodian/Bare/Holding Trust, not your SMSF Trustee nor the SMSF itself.)

A Contract of Sale will be issued within 10 days for your conveyancer to review with you - following that review any suggested changes will be requested by your conveyancer, and if and when they are agreed to by the seller they will be incorporated into the contract - making it ready for you to sign off on - the contract must be signed by the purchaser (you) within 7 days from receipt of those changes. Terms and conditions may vary and are subject to the Developer’s approval – your strategist will be aware of any nuisance and will work with you and your conveyancer.

1. On the submission of this EOI form to the Strategic Investors team, I/we acknowledge that this is a request to the seller of the property to prepare contracts for my/our review and potential execution should I/we choose to move forward.

2. In reserving the Property specified in this EOI form, a Contract of Sale will be forwarded to your Solicitor / Conveyancer as noted above for them to review – they will not commence this review before speaking with you.

3. The Purchaser is encouraged, once the contract is received to a) Meet with their independent legal representative to understand their role in supporting the buyer. b) Have the contract reviewed by your legal representative requesting any changes requested and approved to be incorporated into the contract c) Return the signed “Contract of Sale” within 7 days with any amendments to the Contract of Sale being agreed to and incorporated into the said contract

4. I/We agree to pay the EOI Fee on submission of this form to the Strategic Investors Trust account as consideration and security for the sellers to move forward with the preparation of a contract.

5. The Purchaser acknowledges that the seller incurs considerable costs in managing prospective buyers, including the preparation of contracts.

6. At any time prior to the signing of a Contract of Sale, the Purchaser / Investor may end this Agreement, in which case, the Purchaser’s EOI fee paid shall be refunded in full. The Purchaser acknowledges they are not entitled to any interest which accrues on the Holding Deposit which is held in trust by the Vendor.

8.The EOI Fee paid shall be applied towards the deposit payable under a fully executed “Contract of Sale”.

9. No agreement to sell the Property exists until all parties have signed and exchanged the contract. The issuing of the contract documents is not a promise by the seller to enter into the contract with the buyer.

10. I/We acknowledge that:
a) The Vendor has no obligation to agree to sell the property detailed in this EOI, to me/us, and may refund the EOI Fee paid to me/us in its sole discretion and at any time without being required to justify or explain such action – NB this point is waivered once the fully signed contract is received by both parties
b) Strategic Investors Australia Pty Ltd and its employees, representatives and agents are not liable to me/us as a result of any information, statement, warranty, representation, letter, document or arrangement or any conduct provided, made or done by or on behalf of the Vendor.
c) The information provided in relation to any property in the Development, including its price, is indicative only and may change at any time prior to the exchange of Contracts of Sale; and I/we may not make any objection or claim compensation relating to such a change.
d) This Agreement shall be governed by the Real Estate laws of Australia.

11.By submitting this EOI - Expression of Interest form, the buyer/s acknowledge and agree to the terms and conditions of the process to purchase the above detailed property should all parties be in agreement at all steps

12. Please note that the EOI Fee paid is held in the Developers Trust Account. In the event the sale does not proceed, the EOI Fee Paid (minus any administration fee noted in point 7 – If applicable ) will be refunded fully and be processed within 30 days as per these conditions.
